Terms & Conditions

Important Notice

Bookings made with Toggenburg Experience | A division of HQD Sales and Marketing Services International (hereafter referred to as HQD ) involve an agreement between you and HQD plus other suppliers who provide the services for which you pay. HQD does not own, manage, control or operate any transportation vehicle, hotel, resort or other supplier of services and is not responsible for their acts or omissions. The following information and conditions constitutes your binding contract with HQD and its suppliers. Please read carefully and understand all the information on this page as it sets out the conditions governing the provision of services.

To Make a Booking

HQD accepts bookings direct or through travel agents. All communication prior to your departure, including payment and/or refund transactions will only be either conducted directly or through your travel agent. Bookings are accepted subject to availability and are considered confirmed once the appropriate non-refundable deposit payments or full payments have been received by HQD and written confirmation has been issued. Deposit amount 20% of total price.

Payment

Payment must be made direct or through your travel agent. Direct payment can be made by cheque or bank transfer. In case of a travel agency booking, HQD will hold the travel agent of record responsible for the full amount. Full payment is required 45 days prior to commencement of services. Reservations made within 45 days of commencement must be accompanied by full payment. HQD reserves the right to cancel bookings where payment has not been received within five days of the due date.

Cancellations

The intention to cancel must be communicated in writing to your travel agent or directly. Cancellation penalties will be calculated based on the time notification is received by HQD and are as follows:

· cancellations received up to 45 days prior to departure – deposit amount
· cancellations received between 45 and 21 days prior to departure – 30% of total cost per person
· cancellations received less than 21 days prior to departure – 50% of total cost per person

Cancellation Notifications

It must be sent in writing and shall include all documentation. Insurance: We strongly recommend that you purchase adequate insurance coverage appropriate to your needs.

Changes/Revisions to Bookings

HQD will make every effort to accommodate requests for changes or revisions to bookings. Change fees apply as follows:

· Changes made more than 14 days prior to departure – Swiss Francs 75.
· No changes are possible less than 14 days prior to departure.

Price Increases

All prices advertised in the brochure are calculated using fixed costs at the time of publication. These costs are dependent on rates of exchange and other factors and should these change HQD reserves the right to increase the price. However, should a price increase be greater than 7% the consumer has the right to cancel the contract for travel services and be refunded the total amount paid to HQD unless the increase is as a result of Government imposed taxes. Cancellation of Services: HQD will have no responsibility beyond the refund of all monies received in the event of certain services being cancelled. The refund will be deemed to constitute full and final settlement.

Hotel Ratings

HQD has no control over the official star grading appointed to each hotel, as hotels are allocated their star grading by the Regional Tourist Authority, based on certain predetermined criteria. We have indicated this grading next to each hotel’s description. The official star rating and price will give a good indication of the standard and range of facilities you can expect. Air-conditioning is often controlled by each hotel and restricted according to weather conditions or available mid-June to mid-September only.

HQD Responsibility

HQD takes great care in making arrangements with suppliers of services (i.e.: hotels and golf courses), which together form the travel services you have purchased. HQD acts solely as agents for suppliers, the suppliers are independent parties over which HQD exercises no direct control. HQD shall not be liable for any claims, losses, damages, costs, expenses, delays or loss of enjoyment of any nature or kind whatsoever, to you or your traveling companions or group members, resulting from the acts, omissions or negligence of anyone other than us or our employees acting properly on our behalf. Law, tariffs or conditions on tickets may also limit suppliers’ liability. A travel agent who sells or offers to sell travel services to a customer shall promptly provide the customer(s) a copy of the HQD travel brochure. The agent shall inform the passenger of the need to read the terms and conditions of this brochure. We strongly recommend that you consider the various types of insurance products offered by HQD.

Notice to Travelers

Travelers should be aware that different living standards and practices may exist outside of your home country including but not limited to: provision of utilities, e.g. water and electricity; air-conditioning; accommodations; services of all kinds; food; food preparation; and water quality. HQD shall not be responsible for any loss, damage or injury resulting from different living standards.

Documentation

Travel documents are issued and sent to your travel agent or direct to you no later than 14 days prior to departure. For reservations that include hotel accommodation, excursions, golf arrangements, a voucher is provided in order for you to receive the services booked. It is your responsibility to obtain, at your expense, all documentation required by the relevant government authorities. Ask your travel agent for details. Customs and / or immigration officials, at their own discretion, can deny a traveler entry into their country. HQD cannot be held responsible for denied entry under any circumstances

Refunds

No refunds or adjustments will be made for any portion of the trip or attendant services not taken or used.

Customer Service

HQD must be given every opportunity to resolve customer complaints in destination. All concerns must be addressed to HQD immediately. Claims or demands received after 30 days will not be responded to. In case of a travel agency booking all correspondence must be directed through the travel agent of record. HQD is not responsible for any representations made by Travel Agents, hotel employees or suppliers of any kind. No agent or representative of HQD may waive any provisions of these Terms & Conditions. The invalidity of any provision contained herein shall not affect the validity of any other provision.

Prices contained in the brochure are valid until further notice.
